1. Acceptance of terms
By requesting access to, signing up for, or using Walther Field ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Service.
By using the Service on behalf of a company, you confirm that you have the authority to bind that company to these terms.
2. The Service
Walther Field is a digital platform for conducting asbestos surveys, managing survey data, creating site plans, and generating professional reports. The Service is provided as software-as-a-service (SaaS) and is accessible through a web browser and, where available, through native mobile applications.
We may update, modify, or discontinue features of the Service at any time. We will provide reasonable notice of significant changes.
3. Accounts and access
- The Service is invite-only. Access is granted by the platform operator or by your company administrator.
- You are responsible for keeping your login credentials secure and for all activity under your account.
- You must not share your account credentials with others or allow unauthorised access to the Service.
- You must provide accurate and current information when registering and must keep it up to date.
- Access may be revoked at any time for breach of these terms.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any law.
- Enter data that you do not have the right or authority to process.
- Attempt to gain unauthorised access to other companies' data or to the platform's systems.
- Interfere with or disrupt the Service, its servers, or its security measures.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Use the Service to store or transmit material that is illegal, harmful, or infringes the rights of others.
5. Data protection
Your use of the Service is governed by our Privacy Policy, which describes how we collect, use, and protect personal data. By using the Service, you acknowledge that you have read and understood the Privacy Policy.
Surveying companies are responsible for ensuring they have a lawful basis to process the personal data of their clients that they enter into the Service, and for complying with their obligations as Data Controllers under the UK GDPR and Data Protection Act 2018.
6. Fees and payment
- The Service is provided on a subscription basis with pricing based on the number of surveyor seats.
- Fees are billed monthly in advance.
- Payment terms will be agreed separately when your account is provisioned.
- We may change our fees with reasonable notice. Changes take effect from the start of the next billing cycle.
- Access may be suspended if fees remain unpaid after the due date.
7. Intellectual property
The Service, its software, design, and branding are owned by the platform operator and are protected by intellectual property laws. You retain ownership of all data you enter into the Service (surveys, samples, photos, and client information).
We may use aggregated, anonymised data for service improvement and analytics. We will never identify individual companies or clients in such use.
8. Limitation of liability
- The Service is provided "as is" and "as available". We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
- To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Service.
- Our total liability for any claim arising from the Service is limited to the fees you have paid in the 12 months preceding the claim.
- We are not liable for data loss caused by device failure, loss, or theft where the user has not followed recommended security practices (such as enabling a device passcode).
9. Termination
- You may terminate your account at any time by contacting the platform operator.
- We may suspend or terminate access for breach of these terms, non-payment, or to protect the security of the platform.
- On termination, you may export your data for a period of 30 days. After that, data may be permanently deleted.
- Provisions that by their nature should survive termination (intellectual property, limitation of liability, governing law) remain in effect.
10. Governing law
These terms are governed by the laws of England and Wales. Any disputes arising from these terms or the Service will be subject to the exclusive jurisdiction of the courts of England and Wales.
